1. Acceptance of Terms

By accessing or using MusicianSpace (“the Service”), you agree to be bound by these Terms of Service. IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY — INCLUDING ALL DISCLAIMERS OF LIABILITY AND ASSUMPTIONS OF RISK — YOU MUST STOP USING MUSICIANSPACE IMMEDIATELY AND LEAVE THE WEBSITE.

MusicianSpace reserves the right to update these terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms.

1a. Assumption of Risk Notice

IMPORTANT: MUSICIANSPACE IS A PUBLISHING AND PROFILE WORKSPACE. PUBLIC CONTENT MAY BE INACCURATE, INCOMPLETE, OUTDATED, OR UNSAFE IF USERS ENTER INCORRECT INFORMATION. BY USING THIS SERVICE YOU ACCEPT FULL RESPONSIBILITY FOR REVIEWING WHAT YOU PUBLISH AND FOR ANY CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE OR CONTENT YOU MAKE PUBLIC THROUGH IT.

1b. Notice to European Union Users

If you are located in the European Union, European Economic Area, or United Kingdom, please read this section carefully in addition to the rest of these Terms.

Certain consumer protection laws in EU member states may provide you with rights that cannot be waived by contract. Nothing in these Terms is intended to limit rights that cannot lawfully be excluded under applicable EU law. However, to the maximum extent permitted by applicable EU law:

MusicianSpace expressly excludes all implied warranties and conditions regarding the accuracy, availability, safety, or fitness of user-published content
MusicianSpace's total aggregate liability to you shall not exceed the total amount you have paid to MusicianSpace in the twelve (12) months preceding the claim
MusicianSpace is not a legal, financial, medical, safety, booking, or rights-management advisor. No content on this platform should be treated as professional advice
You voluntarily and knowingly assume all risks associated with publishing, sharing, or relying on user-provided content, including risks that may not be foreseeable at the time of use

EU users acknowledge that MusicianSpace is a profile and publishing workspace, not a professional service provider, and that all responsibility for verifying and safely using published content rests solely with the user.

2. Description of Service

MusicianSpace is a multi-faceted platform that operates in three capacities:

Musician Profile Workspace — users create and manage public musician profiles, links, releases, shows, media, and updates
Public Page Platform — users publish and manage their own musician spaces at username.musicianspace.net
Content Platform — MusicianSpace may publish its own platform pages, documentation, and editorial content at musicianspace.net

Specific features of the Service include:

Musician profile management — profile details, biographies, links, images, releases, shows, and public updates managed from one workspace
Media uploads — images, artwork, and other media uploaded by users for display on their musician spaces
Human-created content — the Service may contain profiles, articles, updates, and documentation written or contributed by users, editors, or creators
User image uploads — ability to upload your own photos and artwork, subject to platform moderation and storage limits
Personal musician-space subdomain — a publicly accessible page at username.musicianspace.net
Publishing metadata — page metadata and structured fields to help public pages render and share correctly

The Service is currently provided free of charge. MusicianSpace may introduce paid plans or usage limits in the future, but any such change will be communicated before it applies.

3. Account Registration

To use MusicianSpace you must:

Create an account using a valid email address or via Google/Facebook OAuth
Provide accurate and complete information
Be at least 13 years of age
Maintain the security of your account credentials

You are responsible for all activity that occurs under your account. You agree to notify MusicianSpace immediately of any unauthorized use of your account at [email protected]. MusicianSpace is not liable for any loss resulting from unauthorized use of your account due to your failure to maintain account security.

3a. Account Security

You are solely responsible for maintaining the confidentiality of your password and account details. You agree to: (a) immediately notify MusicianSpace of any unauthorized use of your account or any breach of security; and (b) ensure that you log out from your account at the end of each session. MusicianSpace will not be liable for any loss or damage arising from your failure to comply with this section.

3b. Modifications to Service

MusicianSpace reserves the right to modify, suspend, or discontinue, temporarily or permanently, the Service or any part thereof, with or without notice. You agree that MusicianSpace will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. MusicianSpace also reserves the right to establish general practices and limits concerning use of the Service, including maximum storage space, and to terminate accounts that are inactive for an extended period of time.

5. User Content and Generated Output

USER CONTENT: You retain ownership of profile details, releases, events, links, images, artwork, updates, and other information you submit to MusicianSpace (“Submissions”). By using the Service, you grant MusicianSpace a limited, non-exclusive, worldwide license to host, process, display, and publish your Submissions solely for operating the Service.

PUBLISHED OUTPUT: Pages, text, media, metadata, and other content assembled from your Submissions are provided for your use. You are solely responsible for verifying any public content before publishing or relying on it.

You agree that MusicianSpace may use anonymized, aggregated data about how the Service is used to improve the platform. MusicianSpace will not sell your personal profile, release, event, media, or update content.

USER IMAGE UPLOADS: If you upload your own photos to the Service, you represent and warrant that:

You own all rights to the uploaded image or have obtained all necessary permissions and licenses
The image does not infringe any third-party copyright, trademark, privacy, or publicity rights
The image does not contain illegal, obscene, or harmful content
You grant MusicianSpace a license to host, display, and serve the image on your musician space

You are solely responsible for ensuring that uploaded images comply with all applicable laws and third-party rights. MusicianSpace is not responsible for any copyright infringement or other claims arising from your uploaded images. All uploaded images are subject to automated content moderation as described in Section 5a.

You are responsible for ensuring that any content you submit, upload, publish, or distribute does not violate third-party intellectual property rights, applicable laws, or these Terms.

5a. Content Moderation

MusicianSpace may use automated and manual moderation tools to review user-uploaded content for prohibited material such as nudity, graphic violence, illegal content, malware, spam, or abuse. By uploading content to the Service, you consent to this review.

MusicianSpace reserves the right to remove any content — including uploaded images, profiles, releases, events, links, or updates — that violates these Terms or is deemed inappropriate at MusicianSpace's sole discretion, without prior notice. MusicianSpace is not obligated to provide a reason for content removal or to maintain a review or appeal process.

Automated moderation is not perfect. MusicianSpace is not liable for any incorrectly removed content or for any prohibited content that is not detected by automated systems.

6. Published Content and User Responsibility

MusicianSpace hosts and publishes content that users provide. BY USING THIS SERVICE, YOU EXPLICITLY ACKNOWLEDGE AND AGREE THAT:

All public content — including profiles, links, releases, events, dates, credits, descriptions, and metadata — may contain errors, inaccuracies, or omissions
MusicianSpace does NOT guarantee the accuracy, completeness, safety, availability, or fitness for any purpose of any user-published content
You are solely responsible for reviewing, verifying, and validating all content before using, publishing, or sharing it
You are solely responsible for any harm, loss, rights dispute, reputational damage, event issue, property damage, or other adverse outcome resulting from using, publishing, or relying on any content published through MusicianSpace
MusicianSpace bears NO responsibility whatsoever for how you or any third party uses, interprets, or acts upon any content displayed on this platform
Published content is provided strictly “as is” without warranty of any kind, express or implied

YOU USE ALL PUBLISHED CONTENT AT YOUR OWN RISK. IF YOU DO NOT ACCEPT FULL RESPONSIBILITY FOR THE CONTENT YOU PUBLISH OR RELY ON, YOU MUST STOP USING MUSICIANSPACE IMMEDIATELY.

6a. Not Professional Advice

NOTHING ON MUSICIANSPACE CONSTITUTES PROFESSIONAL LEGAL, FINANCIAL, MEDICAL, SAFETY, BOOKING, RIGHTS-MANAGEMENT, OR BUSINESS ADVICE. All content published through MusicianSpace is for informational and promotional purposes only.

You should always:

Consult qualified professionals before making legal, financial, medical, safety, booking, rights-management, or business decisions
Verify event dates, venue details, credits, ownership rights, and public claims before publishing
Check links, images, artwork, names, and contact details before sharing content with others
Never rely on public content without independently verifying important facts

MUSICIANSPACE IS NOT RESPONSIBLE FOR ANY LOSS, RIGHTS DISPUTE, REPUTATIONAL DAMAGE, EVENT ISSUE, INJURY, OR OTHER HARM ARISING FROM CONTENT PUBLISHED THROUGH THIS PLATFORM, WHETHER BY YOU OR ANY THIRD PARTY.

6b. User Assumption of All Risk

By continuing to use MusicianSpace, you expressly assume all risks associated with:

Publishing, sharing, or relying on user-provided content
Using profile, release, event, media, link, or update information published through the Service
Publishing content to your musician space and any consequences arising from third parties reading, sharing, or relying on that content
Any unpredictable, unintended, or harmful outcomes arising directly or indirectly from content published on or accessed through MusicianSpace
Any use of MusicianSpace content in any context, whether personal, commercial, or otherwise
Third parties acting on content published through your MusicianSpace page

MusicianSpace, its operators, employees, and affiliates shall bear NO liability for any direct, indirect, incidental, consequential, or any other form of harm — including but not limited to physical injury, illness, allergic reactions, financial loss, reputational damage, or any other adverse outcome — resulting from the use of this platform or its published content, regardless of how such harm occurs.

6c. Uploaded Media Disclaimer

Images and artwork displayed through MusicianSpace are uploaded or provided by users and third parties. You acknowledge and agree that:

Uploaded images may be illustrative, staged, edited, promotional, or otherwise not a complete representation of real-world conditions
Images may not accurately represent current lineup, venue, artwork status, release details, or event conditions
Images may not reflect all metadata, rights, credits, or details associated with the content
MusicianSpace makes no warranty that uploaded images are accurate, current, appealing, lawful, or suitable for any purpose
Uploaded media may be subject to third-party platform, storage, licensing, and acceptable use policies
Uploaded media may resemble, include, or derive from third-party material — you bear sole responsibility for any claims arising from the use of uploaded media

YOU MUST NOT represent images, artwork, or media as owned, original, current, or authorized if that is not true. Doing so may constitute deception and is a violation of these Terms.

6d. Creator Responsibility and Subdomain Policy

SUBDOMAIN LICENSE: Your musician space at username.musicianspace.net is provided as a REVOCABLE LICENSE, not a purchase or ownership of any domain or hosting. MusicianSpace retains full ownership and control of the musicianspace.net domain and all subdomains. MusicianSpace may reclaim, suspend, redirect, or terminate any subdomain at any time, for any reason, without prior notice or compensation.

USERNAME RULES: Your chosen username/subdomain:

Must not infringe any trademark, brand name, or intellectual property of any third party
Must not impersonate any person, company, or organization
Must not be offensive, obscene, or misleading
Cannot be transferred to another user or sold
May be reclaimed by MusicianSpace if your account is suspended or terminated

CREATOR OBLIGATIONS: If you publish content to a public musician space through MusicianSpace, you acknowledge that:

You are the publisher of record for all content on your musician space
You are solely responsible for the accuracy, safety, and legality of content you publish
MusicianSpace is a tool — it is not the publisher, editor, or distributor of your musician-space content
You are solely liable for any harm caused to any third party who reads, follows, shares, or relies on content published on your musician space
You must include appropriate disclaimers where your own content requires context, rights notices, safety information, or independent verification
You must not represent content as reviewed, licensed, endorsed, or authorized by a professional or rights holder unless that is true
You must not represent uploaded images or artwork as original or authorized if that is not true

PAGE AVAILABILITY: MusicianSpace does not guarantee continuous availability of your musician-space subdomain. Maintenance, technical issues, or service disruptions may cause temporary or permanent unavailability. MusicianSpace provides no uptime SLA and is not liable for any loss arising from page downtime.

6e. Structured Content Disclaimer

MusicianSpace may provide structured public-page and publishing features. You acknowledge that:

Structured public-page content may contain errors, omissions, or outdated information
MusicianSpace does not guarantee the accuracy or completeness of structured profile content
You are solely responsible for reviewing and approving public content before publishing
Legal compliance for your profile, media, claims, credits, events, and public statements is entirely your responsibility
MusicianSpace is not liable for any harm arising from inaccurate or incomplete public content

6f. SEO and Search Engine Disclaimer

MusicianSpace may create page metadata, canonical tags, and other publishing metadata for your public pages. You acknowledge that:

MusicianSpace makes no guarantee of any search engine ranking, indexing, sharing preview, or traffic to your page
Search engine and social platform policies vary and may change at any time
Your public content may be penalized, de-indexed, filtered, downranked, or displayed differently by third-party platforms
MusicianSpace is not responsible for any SEO outcome, loss of traffic, or search engine penalties
You are solely responsible for compliance with search engine guidelines and applicable content policies

7. Prohibited Uses

You agree not to use MusicianSpace to:

Publish content that is illegal, harmful, threatening, abusive, defamatory, obscene, hateful, or discriminatory
Violate any applicable local, state, national, or international laws or regulations
Attempt to gain unauthorized access to the Service or other users' accounts
Use automated tools to scrape, crawl, or extract data from the Service
Resell or redistribute the Service without prior written consent from MusicianSpace
Publish spam, misleading content, or unsolicited commercial communications
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload or transmit viruses, malware, or any other malicious code
Interfere with or disrupt the Service or servers or networks connected to the Service
Solicit personal information from anyone under the age of 13
Use the Service or its non-public data to create, develop, or improve competing products or services without authorization
Circumvent, remove, alter, or deactivate any content protection or geographic restriction on the Service
Engage in any data mining, scraping, or similar data gathering methods not authorized by MusicianSpace
Use the Service in any manner that could damage, disable, or impair the Service

In no event will you use non-public Service output, data, or platform behavior to compete with MusicianSpace, including to create a competing product or service. MusicianSpace reserves the right to investigate and take appropriate action against anyone who violates this provision, including terminating their account and reporting them to law enforcement authorities.

7a. MusicianSpace as a Content Platform

In addition to being a user tool and public-page platform, MusicianSpace independently operates a platform website at musicianspace.net. In this capacity:

MusicianSpace may publish its own platform content, documentation, announcements, and editorial pages
MusicianSpace content may be published on public platform pages
Content published directly by MusicianSpace is owned by MusicianSpace and protected by applicable intellectual property laws
You may not reproduce, scrape, copy, redistribute, or create derivative works from MusicianSpace platform content without prior written permission
MusicianSpace platform content is provided for personal, non-commercial use only unless otherwise stated

CONTENT SEPARATION: The MusicianSpace main platform (musicianspace.net) and user musician spaces (username.musicianspace.net) are separate. Content published by a user on their personal musician-space subdomain is not republished, redistributed, or otherwise used on the main MusicianSpace platform without the user's explicit consent, except as needed to operate, display, index, secure, or support the Service. MusicianSpace does not claim ownership of or editorial responsibility for content published on user subdomains.

The presence of user-published content on the platform does not constitute an endorsement, verification, or guarantee of such content by MusicianSpace.

7b. Platform Content Disclaimer

ALL MUSICIANSPACE PLATFORM CONTENT IS PROVIDED FOR INFORMATIONAL, PROMOTIONAL, AND ENTERTAINMENT PURPOSES ONLY. Specifically:

User-published content on the platform may contain errors, inaccuracies, outdated information, or unsafe claims
User-created content is contributed in good faith but is not independently verified by MusicianSpace for accuracy, rights clearance, safety, or completeness
MusicianSpace does not employ licensed legal, financial, medical, booking, rights-management, or safety professionals to review platform content
Metadata information, if provided, may be incomplete or inaccurate
Event times, links, credits, availability, and external platform details may change without notice
Some content may affect rights, credits, event attendance, or public expectations — always verify important details independently
MusicianSpace does not guarantee that any content is safe, suitable, accurate, authorized, or appropriate for any individual or purpose

MUSICIANSPACE IS NOT RESPONSIBLE FOR ANY HARM, RIGHTS DISPUTE, REPUTATIONAL DAMAGE, EVENT ISSUE, PROPERTY DAMAGE, FINANCIAL LOSS, OR ANY OTHER ADVERSE OUTCOME ARISING FROM THE USE OF ANY CONTENT PUBLISHED ON THE MUSICIANSPACE PLATFORM. ALL PLATFORM CONTENT IS USED ENTIRELY AT YOUR OWN RISK.

7c. Human-Created Content and Contributors

The Service may include profiles, updates, pages, and content created by contributors, editors, or authors (“Contributor Content”). With respect to Contributor Content:

MusicianSpace does not independently verify the accuracy, originality, completeness, or safety of Contributor Content
Contributors are solely responsible for ensuring their submissions are original, accurate, lawful, safe, and do not infringe any third-party rights
MusicianSpace reserves the right to edit, modify, publish, or remove any Contributor Content at its sole discretion without notice or compensation
By submitting content to MusicianSpace as a contributor, you grant MusicianSpace a worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and publish your content across MusicianSpace platforms
Contributors warrant that their submitted content is original, does not infringe any third-party intellectual property rights, and does not contain harmful, misleading, or illegal information
MusicianSpace is not liable for any claims arising from Contributor Content including but not limited to intellectual property infringement, inaccurate information, safety issues, or any harm suffered by readers

The MusicianSpace platform, including its design, code, branding, and original content, is owned by MusicianSpace and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without prior written permission.

8. Intellectual Property

8a. Copyright / DMCA

MusicianSpace respects the intellectual property of others. If you believe that content on MusicianSpace infringes your copyright, please send a written notice to [email protected] with the subject line “DMCA Takedown Request” including:

A physical or electronic signature of the copyright owner or authorized representative
Identification of the copyrighted work claimed to be infringed
Identification of the infringing content and its location on the Service
Your contact information (address, telephone number, email)
A statement of good faith belief that the use is not authorized by the copyright owner
A statement, under penalty of perjury, that the information in the notice is accurate

MusicianSpace will process valid DMCA notices and take appropriate action, including removing infringing content and terminating repeat infringers' accounts.

8b. Third-Party Services

The Service relies on and may display links to third-party services including Google and Facebook (authentication), infrastructure and storage providers, security providers, email providers, analytics providers, and Cloudflare (infrastructure and analytics). MusicianSpace has no control over and is not responsible for the accuracy, availability, reliability, or content of any third-party services. Your use of third-party services is at your own risk and subject to those third parties' own terms and conditions and privacy policies. MusicianSpace will not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with use of or reliance on any third-party service. Disruption or changes to any third-party service may affect MusicianSpace's functionality and MusicianSpace is not liable for any resulting impact on your use of the Service.

9. Account Deletion, Data Loss, and Backups

If you delete your account or your account is terminated:

Your musician-space subdomain will be taken offline and may be reclaimed by MusicianSpace
All profiles, images, media, links, releases, events, updates, and public content associated with your account may be permanently deleted
Deleted content cannot be recovered after account termination
MusicianSpace will retain certain data as required by law or for legitimate business purposes as described in the Privacy Policy
You may request a copy of your data before deletion by contacting [email protected]

MusicianSpace recommends exporting or backing up any content you wish to keep before deleting your account.

9a. No Liability for Data Loss

MUSICIANSPACE DOES NOT GUARANTEE THE PRESERVATION, AVAILABILITY, OR INTEGRITY OF ANY DATA, CONTENT, PROFILES, IMAGES, MEDIA, LINKS, RELEASES, EVENTS, UPDATES, OR OTHER MATERIALS STORED OR PUBLISHED THROUGH THE SERVICE.

Data loss may occur as a result of, but not limited to:

Technical failures, server outages, or infrastructure issues
Accidental or unauthorized deletion
Cyberattacks, hacking, or security breaches
Software bugs or errors
Account suspension or termination
Discontinuation of the Service
Force majeure events as described in Section 16
Any other cause, whether foreseeable or unforeseeable

MUSICIANSPACE SHALL NOT BE LIABLE FOR ANY LOSS OF DATA, CONTENT, PROFILES, IMAGES, MEDIA, LINKS, RELEASES, EVENTS, UPDATES, OR ANY OTHER MATERIALS, REGARDLESS OF THE CAUSE. THIS INCLUDES BUT IS NOT LIMITED TO DIRECT LOSS, CONSEQUENTIAL LOSS, LOSS OF BUSINESS, LOSS OF REVENUE, OR ANY OTHER DAMAGES ARISING FROM DATA LOSS.

YOU ARE SOLELY RESPONSIBLE FOR MAINTAINING INDEPENDENT BACKUPS OF ALL CONTENT YOU CREATE, UPLOAD, OR PUBLISH THROUGH MUSICIANSPACE. MusicianSpace strongly encourages you to regularly export and back up your profiles, images, media, links, releases, events, updates, and public content to your own storage. While MusicianSpace will make reasonable efforts to prevent data loss, these efforts do not constitute a guarantee and MusicianSpace assumes no responsibility for any failure to preserve your data.

IF YOU DO NOT MAINTAIN YOUR OWN BACKUPS, YOU ACCEPT ALL RISK OF PERMANENT DATA LOSS. MUSICIANSPACE WILL NOT BE OBLIGATED TO RESTORE ANY LOST DATA UNDER ANY CIRCUMSTANCES.

10. Termination

MusicianSpace reserves the right to suspend or terminate your account at any time, for any reason, including violation of these Terms, without prior notice. Upon termination, your right to use the Service will immediately cease. MusicianSpace may also immediately deactivate or delete your account and all related data upon termination. MusicianSpace will not be liable to you or any third party for any termination of your access to the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. MUSICIANSPACE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

MUSICIANSPACE MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND REGARDING ANY CONTENT PUBLISHED THROUGH THE SERVICE, INCLUDING ITS ACCURACY, SAFETY, RELIABILITY, AVAILABILITY, AUTHORIZATION, OR SUITABILITY FOR ANY PURPOSE. YOU ACKNOWLEDGE THAT ANY RELIANCE ON PUBLISHED CONTENT IS AT YOUR SOLE RISK.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MUSICIANSPACE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO:

Physical injury, loss, rights disputes, or reputational harm arising from relying on published content
Property damage or financial loss resulting from relying on public content or external links
Loss of profits, revenue, data, or business opportunities
Any harm caused to third parties by content published through the Service
Any unpredictable, unforeseeable, or unprecedented harm arising from use of the Service
Any damages arising from reliance on user-published content by you or any third party

IN NO EVENT WILL MUSICIANSPACE'S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE TOTAL AMOUNT YOU HAVE PAID TO MUSICIANSPACE IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

THIS LIMITATION APPLIES REGARDLESS OF THE LEGAL THEORY UNDER WHICH DAMAGES ARE SOUGHT, WHETHER IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, AND EVEN IF MUSICIANSPACE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IF YOU ARE DISSATISFIED WITH ANY PART OF THE SERVICE OR THESE TERMS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USE OF THE SERVICE IMMEDIATELY.

13. Indemnification

You agree to indemnify, defend, and hold harmless MusicianSpace and its operators, affiliates, officers, agents, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

Your use of or access to the Service
Your violation of these Terms of Service
Any content you submit, upload, publish, or distribute through the Service
Any harm caused to any third party by content published on your MusicianSpace page
Your violation of any third-party rights, including intellectual property, privacy, or safety obligations
Any claim brought by a third party who followed or relied on content published through your musician space

This indemnification obligation applies to the maximum extent permitted by applicable law, including EU member state laws.

14. Dispute Resolution and Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS.

YOU AND MUSICIANSPACE AGREE THAT ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL BE RESOLVED EXCLUSIVELY THROUGH FINAL AND BINDING ARBITRATION, RATHER THAN IN COURT, EXCEPT THAT YOU MAY ASSERT INDIVIDUAL CLAIMS IN SMALL CLAIMS COURT IF YOUR CLAIMS QUALIFY.

BY AGREEING TO ARBITRATION, YOU AND MUSICIANSPACE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. YOU MAY ONLY BRING CLAIMS AGAINST MUSICIANSPACE IN YOUR INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

Arbitration will be conducted by a neutral arbitrator under the American Arbitration Association's Consumer Arbitration Rules. Any arbitration hearings will be conducted remotely where possible. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Pre-Arbitration: Before initiating arbitration, you agree to first contact MusicianSpace at [email protected] and attempt to resolve the dispute informally. If the dispute is not resolved within 30 days, either party may initiate arbitration.

For EU users: nothing in this section removes your right to rely on mandatory consumer protection provisions of the law of your country of residence.

15. Time Limitation on Claims

YOU AGREE THAT ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO USE OF THE SERVICE OR THESE TERMS MUST BE FILED WITHIN ONE (1) YEAR AFTER SUCH CLAIM OR CAUSE OF ACTION AROSE. ANY CLAIM NOT FILED WITHIN THIS PERIOD SHALL BE FOREVER BARRED. This limitation applies to the maximum extent permitted by applicable law.

16. Force Majeure

MusicianSpace will not be liable for any failure or delay in performance of its obligations under these Terms arising from circumstances beyond its reasonable control, including but not limited to: civil disturbances, epidemic or pandemic, hostilities, war, terrorist attacks, natural disasters, acts of God, flood, fire, power outages, network failures, or any other event outside MusicianSpace's reasonable control.

17. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. For disputes not subject to arbitration, you consent to the exclusive jurisdiction of courts located in the United States.

For EU users: nothing in these Terms removes your right to rely on mandatory provisions of the law of your country of residence. However, any disputes not resolved by mandatory local law shall be subject to binding arbitration under US law.

18. General

These Terms constitute the entire agreement between you and MusicianSpace regarding use of the Service. If any provision of these Terms is found invalid by a court, the remaining provisions will continue in full force. MusicianSpace's failure to enforce any right or provision will not constitute a waiver. You may not assign these Terms without MusicianSpace's prior written consent. MusicianSpace may assign these Terms without restriction. Section titles are for convenience only and have no legal effect.
